The chief of Kirkuk Provincial Council, Ribwar Talabani, told Rudaw that the court called it legal for the region’s flag to be hoisted from official premises in the province.
The rule came after some Kirkuk Turkman and Arabs filed a lawsuit against Talabani for hoisting the flag in the premises of the province.

However, the spokesman for the Federal Court Ayas Samuk told NRT that the court said it decided neither in favor nor against raising the Flag of Kurdistan in Kirkuk because it 'lacked competence' to do so,.
Samuk, however, did not say the constitutionality of the decision to raise the flag of the Kurdistan Region in the province of Kirkuk.
"The court heard an appeal on the Kirkuk Provincial Council's decision on raising the flag of the Kurdistan region on the buildings of the province, and found that the decision… is beyond authorities of the jurisdiction of the Federal Supreme Court."
Kirkuk council members voted overwhelmingly on March 28 in favor of raising the Kurdistan flag over official buildings during a meeting boycotted by Turkmen and Arabs.
Kirkuk Provincial Council members on April 4 voted overwhelmingly in opposition to the Iraqi Parliament’s decision to lower the Kurdistan flag over government buildings in Kirkuk.
